As a user of this website (referred to as “you/your”), you acknowledge that any use of this website, including any transactions you make (“use/using”), is subject to our terms and conditions
These terms of trade apply wherever Aquarius Spiritus Pty Ltd (trading as Aquarius Spiritus ABN: 54 641 082 171 supplies products to any customer unless otherwise specified by Aquarius Spiritus in writing. By placing an order with us, you accept and agree to be bound by these terms.

An order (“Order”) for the Goods from the Buyer shall be deemed to be an offer by the Buyer to purchase the Goods. Aquarius Spiritus’s acceptance of the Buyer’s offer will occur when the Buyer receives written acknowledgement from Aquarius Spiritus, or upon delivery, whichever occurs first;
By offering to purchase or purchasing the Goods, the Buyer agrees to be bound by the Agreement, which constitutes the entire Agreement between the parties. All other terms or conditions including those in the Buyer’s offer or any other document from the Buyer are excluded unless otherwise agreed in writing by Aquarius Spiritus at the time of acceptance;
Any variation to the Agreement must be made in writing and signed by or on behalf of an authorised representative of the parties;
All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions.
The checkout stage sets out the final details of your order. Following this, we will send you an order acknowledgement e-mail detailing the products you have ordered. Please note that this e-mail is not an order confirmation or order acceptance from Aquarius Spiritus.
Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with these terms and conditions (please refer to Returns and Cancellations
- PAYMENT
We take payment using your specified payment method at the time we receive your order once we have checked your payment details. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.
The price you pay is the price displayed on this website at the time we receive your order, and no other prices published by Snooze are applicable to these items EXCEPT THAT while we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
Payment can be made by any method specified on this website.
Title to any products you order on this website shall pass to you on delivery of the products provided that we have processed and received payment in full for the products.
o Unless otherwise stated, the Purchase Price does not
include sales tax, goods and services tax or any other tax, duty or impost
levied over the Goods in Australia or elsewhere.
o All such taxes, duties and imposts will be added to the
price at the designated rate.
o Unless stated otherwise, all prices, quotes or other
amounts are in Australian Dollars (AUD$);
o Aquarius Spiritus Pty Ltd reserves the right to make any
changes necessary to the price to cover any cost variation, including (but not
limited to):
1. any act or omission on the Buyer’s part or the part of
the Buyer’s agents; and/or,
2. to correct any typographical or clerical errors which
maybe present in the prices, deliveries or specifications in any quote or
offers
3. Any adverse change in monetary exchange rates;
4. Any increases in our costs beyond our control which will
result in the price being increased by the same amount;
- SHIPPING
You will be responsible for paying for your shipping costs
if the product is found to be non-faulty of goods found
to be in good shape, you will be charged an additional 20% charge of the
original invoice value for that item.
If goods are proved to be faulty, then credit for
shipping and the full invoice will be refunded.

- is free for all orders over $350 worth (excl. GST)
- DISPATCH NOTIFICATION
Please note we will
e-mail you the Order Confirmation within 24 hours. Upon dispatch of the goods,
you will receive an e-mail notification within the following 24 hours with your
tracking number.
- RETENTION OF TITLE
o Ownership, title and property in the Goods and any
proceeds of the sale of those Goods remains with Aquarius Spiritus Pty Ltd
until payment in full for the Goods and all sums due and owing by the Buyer to
Aquarius Spiritus Pty Ltd on any account has been made. Until the date of
payment:
1. the Buyer has the right to sell the Goods in the
ordinary course of business;
2. the Goods are always at the risk of the Buyer;
o The Buyer is deemed to be in default immediately upon the
happening of any of the following events:
1. if any payment to Aquarius Spiritus Pty Ltd is not made
promptly before the due date for payment;
2. if the Buyer ceases to carry on business or stops or
suspends payment or states its intention of so doing or is unable to pay its
debts as they fall due or if any cheque or bill of exchange drawn by the Buyer
payable Aquarius Spiritus Pty Ltd is dishonoured;
o In the event of a default by the Buyer, then, without
prejudice to any other rights which Aquarius Spiritus Pty Ltd may have at law
or under this Agreement:
1. Aquarius Spiritus Pty Ltd or its agents may, without
notice to the Buyer enter the Buyer’s premises or any premises under the
control of the Buyer to recover the Goods;
2. Aquarius Spiritus Pty Ltd may recover and resell the
Goods;
3. If the Goods cannot be distinguished from similar Goods
which the Buyer has or claims to have paid for in full, Aquarius Spiritus Pty
Ltd may, in its absolute discretion, seize all goods matching the description of
the Goods and hold same for a reasonable period so that the respective claims
of Aquarius Spiritus Pty Ltd and the Buyer may be ascertained.
4. Where the buyer requests a refund under certain conditions from Aquarius Spiritus Pty Ltd
Aquarius Spiritus Pty Ltd will not accept refunds for:
Change of mind for order
Incorrect Colour ordered
Incorrect product ordered
Incorrect size ordered
5. Where the Buyer establishes ownership, Aquarius Spiritus
Pty Ltd must promptly return the Buyer any such goods. However, Aquarius
Spiritus Pty Ltd shall in no way be liable or responsible for any loss or
damage to the Goods or any loss, damage or destruction to the Buyer’s business
howsoever arising from the seizure of such Goods.
